Your agreement

Evals AX is operated by THOR APPS, LLC, a Florida limited liability company. These terms govern your use of the hosted service when you affirmatively accept them. You must be at least 18 and able to enter an agreement. If you act for an organization, you represent that you have authority to bind it; “you” then includes that organization. An agent may accept only with that authority. Merely visiting a page or previously using an account is not recorded as acceptance.

Open-source software is provided under the license included with its distribution. These hosted-service terms do not remove rights granted by that license.

What the service provides

Evals AX helps you examine environments used by agents, store experiment evidence and run bounded audits of public websites. Static findings suggest investigations; they do not demonstrate that a change improves task performance. Results depend on the task, model, environment and recorded experimental scope. Uploaded results are reported by the originating host, not independently certified by the hosted service.

You are responsible for checking results before relying on them. The service does not provide legal or other professional advice, security certification, or a guarantee of accessibility, agent performance or business outcomes. Local experiments run under your host configuration and your chosen providers; you control that execution and its costs.

Accounts and authorized use

Provide accurate account information, protect your credentials, and revoke tokens you no longer need. Contact us promptly about suspected account compromise. You are responsible for instructions you authorize your agents to carry out and for activity through credentials you provide, subject to applicable law.

Use the service only for lawful purposes and with authority to submit the relevant material or request the activity. Do not send secret credentials, confidential links, or sensitive regulated data. Do not attempt unauthorized access, interfere with other users, evade admission or spending controls, or use the service to harass or harm others. Do not represent an unverified result as a certification from us.

Your material and public reports

You retain rights you hold in your submitted material and results. You give us a limited, non-exclusive permission to process, store and display that material as needed to provide the requested service, maintain security and comply with law. This does not transfer ownership to us or give us a general license to train models on your private material.

A website report is accessible to anyone holding its public report link. It includes the submitted URL, findings and selected evidence snippets. A no-index request does not make it private. Private projects and experiments are account-scoped. Review prompts and local paths in manifests before uploading; raw local agent traces are not uploaded by default.

The privacy policy explains handling of personal data, retention and available deletion controls. Deleting a report disables its service link and removes its content from live report storage, but cannot recall copies held by others. Keep your own exports of evidence you need.

Service rights and feedback

We and our licensors retain rights in the service and branding, subject to the open-source licenses that apply to released software. These terms do not grant ownership of our trademarks.

If you voluntarily give us suggestions, you permit us to use them to improve the service without an obligation to pay or attribute you. That permission is non-exclusive and does not transfer ownership of your underlying work. Do not include confidential information in feedback unless we have agreed to receive it on that basis.

Early access, limits and changes

The hosted service is in early access. Published capacity and retention limits apply; free access is not a promise of permanent archival storage or a service-level guarantee. We may change or discontinue features. Where practical, we will provide reasonable advance notice of a material reduction that affects active users and an opportunity to export their data.

We may promptly restrict work when necessary to address security, unlawful use, a service incident or uncontrolled infrastructure costs. We aim to preserve access to existing data and deletion controls where lawful and technically practical.

Any future paid service

Free use does not automatically become a paid subscription. A paid purchase requires a separate affirmative action after the price, billing interval, renewal terms, included capacity, cancellation process and applicable refund terms are shown. We do not authorize uncapped pass-through charges for model or infrastructure providers under these terms.

No paid checkout is offered by this version of the service. If we introduce one, any additional purchase terms will apply only when accepted. Mandatory cancellation, refund and consumer rights remain available.

Leaving or suspending the service

You may stop using the service and use the available export and deletion controls. Contact us to coordinate closure across the hosted service and authentication provider; deleting an authentication account alone does not currently erase every separate service record.

We may suspend or terminate access for a material breach of these terms, unlawful use, security risk, or failure to pay fees separately agreed to. Where lawful and practical, we will explain the reason, offer a chance to remedy a remediable breach and allow reasonable export access. Urgent protective action may precede notice. Legal preservation requirements can limit immediate deletion. Termination does not revoke open-source rights already granted.

Warranties and responsibility

To the extent permitted by law, the early-access service is provided as available, without promises that it will be uninterrupted, error-free, or suitable for a particular purpose. We disclaim implied warranties only to the extent the law allows, including merchantability, fitness for a particular purpose and non-infringement.

For business use, to the extent permitted by law, neither party is liable to the other for indirect or consequential losses, lost profits or anticipated savings arising from the service. Our total liability arising from the hosted service is limited to the greater of US$100 or the fees you paid us for that service in the 12 months before the event giving rise to the claim.

Nothing in these terms excludes liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability or remedy that cannot lawfully be limited. Mandatory consumer protections and data-protection rights are preserved. The business liability limits do not override those rights.

Disputes and applicable law

Please first contact erik@evals.ax about a dispute so we can try to resolve it. Florida law governs this agreement, excluding its conflict-of-law rules, except where mandatory law gives you protections that cannot be displaced by that choice.

For business disputes, the state or federal courts in Florida that have jurisdiction are the agreed courts. Consumers retain any mandatory right to bring a claim in their local courts or rely on applicable local law. These terms do not require arbitration or waive class-action rights.

Versions and contact

We publish a version and effective date with each revision and preserve the prior terms. Material revisions will receive reasonable notice before they apply where practical; new account work requires affirmative acceptance of the current version. We do not rewrite prior acceptance records or apply revised terms retroactively to accrued disputes.

If a provision is unenforceable, the rest remains effective to the extent permitted by law. A separately signed agreement overrides these terms only to the extent it expressly says so.
